A Complete Guide for changing name in Republic of India

Recently completed the Gender Change Therapy or you're simply not loving your name, then probably a name change is what you seeking for. It's always better to seek advice from someone experienced rather than anyone who have just knowledge of it.  So, here is mine, how i got it done all myself with a little help. Let me navigate you through a quick demonstrations on how to get it done in the quickest & precise way.

Broadly classified, the procedure for name change involves only three steps:
  1. Make an affidavit for change of name
  2. Newspaper Advertisement
  3. Gazette Notification
Note: To change name by oneself, the first and foremost criteria to be met by a name change applicant is that he/she should be over 18 years age. The procedure is different for the name change of a minor. Here goes the detailed information about what one needs to do in order to change name.

Create An Affidavit For Change Of Name

An affidavit is required explaining why the name change is opted by the person who is making the affidavit besides affirming these details on Non Judicial stamp of minimum value-
  1. Full name of the applicant (deponent)
  2. Father’s name or husband’s name (in case of married women)
  3. Full residential address
  4. A declaration stating that the facts provided in the affidavit are true and correct
Here is the Name Change Affidavit Proforma i got printed on stamp paper. Once affidavit is prepared get it signed and attested from a Notary Public or an Executive Magistrate. (Note: It's always a best practice to get the affidavit signed and attested before a Judicial/Executive Magistrate. )

Important Note:
  • If the applicant is a Government employee, he/she can submit a deed for change of name in accordance with the rules stated in the Office Memorandum No. 19016/01/87 as issued by the Ministry of Home Affairs.
  • If the applicant is an Indian living abroad, then he/she should submit deed duly attested by the Indian Embassy or Indian High Commission, in original to the Authority.


Place An Advertisement In Newspaper
Place an advertisement in an English National Daily newspaper with details of change of name. Just one English National Daily newspaper will serve the purpose. There's no need to go for advertisement in more than One or in local newspapers.

The format for placing a name change ad in newspaper is as below-

I, ABHISHEK RAJ, S/o- Kailash Prasad R/o Vill-Hasanpur Kirat, Post-Muktapur, P.S.-kALYANPUR, Dist-Samastipur, Bihar-8481012 have changed my name to SHARVIN SOHAM vide affidavit number W385679 before executive Magistrate Samastipur on July 25th, 2019.

Gazette Notification
Read Guidelines for Notification Publication for change of Name Adult
The following documents are required for publication of advertisement in the Gazette of India part IV
  1. Affidavit or Undertaking duly signed by the applicant
  2. Original Newspaper (Cover Page+Page on which advertisement is published)
  3. Prescribed pro-forma in duplicate(i.e. two copies) duly typed with signature of applicant and two witness
  4. C.D. containing the print matter without witness portion in MS Word and type old name in place of signature (You can get a CD with print matter at a Kiosk at Department of Publication only if you're visiting in person.)
  5. Two self attested passport size photographs and photocopy of ID proof (self attested).
  6. A certificate duly signed by the applicant declaring therein that the contents of hard copy and soft copy are similar.
  7. Request letter along with the requisite fee.
  8. Pay in Cash at Cash Kiosk on visiting or online at Non Tax Receipt Portal (Confirm DDO {see image} from Department of Publication)

Now, I request you to visit Department of Publications (Government of India) or contact: 011-23810150 & make enquiry regarding requisite fee for Change of Name & cross check with them with your documents.

Transaction Receipt will look something alike this.  will look something alike this. (Get two copies of print of Transaction Receipts)

All the aforesaid documents, printing charges together with forwarding letter and Photo ID Proof addressed to The Controller of Publications, Department of Publication, Civil Lines, Delhi-110054 should either be submitted personally or be sent by post to this Department. 

Note:
  • The documents must not be older than one year.
  • The documents once submitted in this Department will not be returned in any circumstances; neither original nor Xerox copy.
Submit papers to The Department of Publication for publishing a Notification in Gazette & say Voila

  2. SEARCH CATEGORY-WEEKLY GAZETTE
  3. IN SELECT PART AND SECTION- PART IV
  4. ENTER RANGE OF DATES (It will be published withing 15 days on any saturday)
  5. DOWNLOAD THE REQUISITE PDF FILE.
  6. USE CONTROL KEY+F KEY TO FIND YOUR NAME (OLD/NEW) 
  7. DOWN LOAD THE WHOLE GAZETTE TO MAKE YOUR OWN COPY. 
THIS FURTHER NEEDS NO CERTIFICATION FROM THE DEPARTMENT
